1. Introduction

Welcome to PokerPortal. These Terms of Service ("Terms") govern your access to and use of PokerPortal's website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

PokerPortal is operated by VG Tæknilausnir ("we," "us," or "our"), providing cash game tracking software as a service.

2. Service Description

PokerPortal provides cash game management and tracking software with the following tiers:

  • Lite: Free tier for casual games with basic buy-in, add-on, and cashout tracking for friends and small groups
  • Pro: Paid subscription for enhanced features including multi-table support, visual table layouts, and rake/shop tracking
  • Business: Custom enterprise solution for professional poker clubs with unlimited tables, admin dashboards, player balance management, loan systems, and multi-user access

3. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

4. Subscriptions and Billing

Paid subscriptions (Pro and Business tiers) are billed on a recurring basis. By subscribing, you agree to the following:

  • Your subscription will automatically renew at the end of each billing period unless cancelled
  • You authorize us to charge your payment method for the recurring subscription fee
  • Subscription fees are subject to change with 30 days notice
  • You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period
  • No refunds will be provided for partial billing periods except as outlined in our Refund Policy

5. Acceptable Use

You agree not to use the Service to:

  • Engage in any illegal activity or facilitate illegal gambling operations
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use the Service for any commercial purpose other than its intended use
  • Reverse engineer, decompile, or otherwise attempt to extract the source code

6. Service Availability

While we strive to provide reliable service, we do not guarantee that the Service will be uninterrupted or error-free. We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service at any time
  • Perform scheduled maintenance with reasonable notice
  • Respond to emergencies or technical issues without notice

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by PokerPortal and is protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKERPORTAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your data

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO POKERPORTAL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless PokerPortal and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Iceland and the European Economic Area (EEA). Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Iceland.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.
